NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE

By virtue and in execution of the Power of Sale Provision contained in the Decree of Foreclosure by Judicial Sale of the Vermont Superior Court, Civil Division, Windham Unit, Docket No. 25-CV-03089 enforcing the mortgage dated May 24, 2024 given by Design Street LLC to Citadel Servicing Corporation d/b/a Acra Lending, and recorded with the Town of Dover Land Records in Book 395, Page 119.
For breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at the premises located at 58 Buckboard Drive, West Dover (Dover), VT 05356 on July 20, 2026, at 11:00 A.M., all and singular the premises described in said mortgage, to wit:
Being all and the same lands and premises conveyed to Design Street, LLC by Warranty Deed of Domingos Leal dated May 24, 2024, recorded in Book 395, Page 116 of the Town of Dover
Land Records. Being all and the same lands and premises as were conveyed to Domingos Leal and Lisa Ganley-Lean (deceased) by Warranty Deed of Nancy Noli and Gabriel Noli, dated September 11, 2019 and recorded September 26, 2019, at Book 356, Page 471 of the Dover Land Records, and as further described therein as follows, viz: “All that certain piece of parcel of land, with the buildings and improvements thereon, known as 58 Buckboard Drive, situated in the Town of Dover, Vermont and more particularly described on the attached Schedule A. “Being the same premises conveyed to Nancy Noli and Gabriel Noli herein by Warranty Deed from Hunter A. Charnow and Alma Jane Charnow, dated December 12, 1997 and recorded in the Dover Land Records in Volume 157, Page 579. “Being all of PARCEL NO. TWO conveyed to S. William and Ursela Whyte by warranty deed of Vermont Lumber Corporation dated January 11, 1969 recorded in Volume 25, Page 44 of the Dover Land Records and therein described as follows: “PARCEL NO. TWO: Being all of Lot No. 95W in Dover-Hills West Portion, so-called, described as follows: “Beginning at a point marked by an iron pin in the ground, said iron pin marks the southwest corner of the premises herein conveyed and is located on the northerly side of Buckboard Drive thence North 43° 39’ 12” East a distance of 346.20 feet to an iron pin in the ground thence North 87° 03’ 34” East a distance of 135.00 feet to an iron pin in the ground; 19° 24’ 51” East ground; South in the distance of 525.07 feet (to) an iron pin in the ground located on the northerly side of Buckboard Drive; thence northwesterly along the northerly side of said Buckboard Drive a distance of 90.92 feet to the point and place of beginning, said premises being all of Lot No. 95W to contain 1.46 acres more or less, for a more particular description of the premises above described further reference may be had to survey completed by R. U. Joyce, surveyor, which survey is to be recorded with the Dover Town Clerk. “The above parcel of land being a part of the premises conveyed to Vermont Lumber Corporation by warranty deed dated March 20, 1968 of Colman Holding Corp, recorded in Volume 24, Pages 28-29 of the Dover Land Records to which deed and the record thereof and the deeds, instruments and records therein or thereby referred to further reference may be had for a more particular description of the premises hereby conveyed. “The grantor hereby conveys to the grantee, their heirs and assigns, the right to pass and repass, with vehicles or otherwise, in common with the grantor, its successors or assigns, and others, over and upon a strip of land fifty (50’) feet in width (as delineated on the above referred to map of Lot No. 95W completed by Richard Joyce, Surveyor) leading from the subject premises to Dover Town highway until such time as this strip of land to be used as a roadway becomes a Dover Town Road and maintained as such.”
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
The premises shall be sold 
and conveyed AS IS, WITH ALL FAULTS, WITH NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE: The public sale may be adjourned one or more times for a total time not exceeding 30 days, without further court order, and without publication or service of a new notice of sale, by announcement of the new sale date to those present at each adjournment or by posting notice of the adjournment in a conspicuous place at the location of the sale. Terms of
Sale: $10,000.00 to be paid in cash or by certified check by the purchaser at the time and place of sale. The balance is to be paid by wire transfer to Demerle & Associates P.C., 10 City Square, 4th Floor, Boston, MA 02129 within sixty (60) days after the date the Confirmation Order is entered by the Court. The sale is subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens, if any, which take precedence over the said mortgage above described.
The mortgagor and all junior lienholders are entitled to redeem the mortgaged property at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.

Pursuant to law, notice is hereby given that a public hearing will be held by the WHITINGHAM ZONING BOARD OF ADJUSTMENT (ZBA) on Wednesday, JULY 29, 2026, at 6:00 PM at the WHITINGHAM MUNICIPAL CENTER, 2948 VT Route 100, Jacksonville, VT 05342 for the purpose of determining “New England style architecture” as required in the Village district (section 5.1.4 c) on:
